The ground rules, in plain language.

These General Terms of Use (“CGU” — Conditions Générales d'Utilisation) set out the conditions of access to and use of the website published by BRAINEE (SIREN 849 355 383), of its candidate area and of the services associated with the certification Construire une application grâce au Vibe Coding (RS7554).

Any consultation or use of the website implies full and unreserved acceptance of these CGU. If the user disagrees with them, they must stop using the service.

• Website: all pages accessible from the domain iq-certification.ai and its subdomains.
• User: any person who consults the website, whether or not they hold an account.
• Candidate: a user who has created an account in the candidate area in order to prepare for and sit the certification.
• Certification: the RS7554 certification registered in the Répertoire Spécifique of France Compétences.
• Exam: the assessment giving rise to the measurement of skills and the award of a score out of 100.
• Certificate: the personal, digital attestation issued to a candidate who has passed the exam.

To create an account, the user must be of legal age or have the authorisation of their legal representative. They declare that they have the legal capacity to subscribe to the service and that they provide accurate information when registering.

A natural person may hold only one candidate account. Duplicate accounts, or accounts created under a fictitious identity, may be suspended.

Creating an account is free. It requires a valid email address and a strong password. The candidate is solely responsible for the confidentiality of their credentials and for any action carried out from their account.

In the event of loss or suspected unauthorised access, the candidate must reset their password without delay from the “Forgotten password” page and notify us if necessary.

The candidate may request deletion of their account at any time from their dashboard or by email to certification@iq-certification.ai. Certain data may be retained for legal reasons (see privacy policy).

The typical journey is as follows:

1. Creating the account and completing the application file (identity, professional profile).
2. Online payment by bank card via Stripe (see Terms of Sale).
3. Scheduling the exam slot from the candidate area.
4. Sitting the exam under the conditions provided for.
5. Provision of the score, the level attained and — where the candidate passes — the digital certificate.

The value of the certificate depends on the integrity of the exam. On that basis, the candidate undertakes to:

• sit the exam themselves, without any substitute, and without working on the exam as a group;
• refrain from using unauthorised tools and comply with the instructions specific to each exam;
• refrain from distributing, reproducing or commercialising all or part of the exam content;
• provide proof of identity if a reasonable verification is requested of them.

The user undertakes not to:

• disrupt the operation of the website or access it by means other than those provided for;
• extract content on a large scale, in particular through automated scraping;
• impersonate a third party or another user;
• attempt to circumvent the authentication, payment or exam proctoring mechanisms.

BRAINEE may suspend or terminate access to the account in the event of a breach of these CGU, fraudulent use, attempted exam fraud, or use that harms the security of the service. The candidate is notified where this is possible. Any financial consequences are governed by the Terms of Sale.

BRAINEE implements reasonable means to ensure the availability of the website, without undertaking an obligation to achieve a specific result (obligation de résultat). Interruptions may occur, in particular for maintenance, updates, an incident at a technical processor, or force majeure. The candidate will be informed where such interruptions affect an exam in progress.

The website, its trademark, its content, its interface and its source code are protected by intellectual property law. The content of the exams is confidential and is the property of BRAINEE. Personal, non-commercial use of the published information is permitted; any other use requires BRAINEE's prior written agreement.

The processing of personal data carried out in connection with the service is described in the privacy policy, which sets out in particular the purposes, the legal bases, the recipients, the retention periods and the ways to exercise GDPR rights.

BRAINEE is bound by an obligation of means (obligation de moyens). It cannot be held liable for indirect damages (loss of opportunity, loss of data, commercial harm) resulting from the use of the service. BRAINEE's liability towards a candidate is, in any event, limited to the sums actually received in respect of the service concerned.

BRAINEE may amend these CGU to reflect changes to the service or to the applicable regulations. The version in force is the one accessible on the website on the date of use. In the event of a substantial change affecting the rights of active candidates, prior information is provided by email or by notification in the candidate area.

These CGU are governed by French law. Failing an amicable agreement, any dispute will be brought before the competent French courts, subject to the mandatory rules applicable to consumers.
