Scope
These General Terms of Sale (“CGV” — Conditions Générales de Vente) apply to any order placed by a candidate — whether a consumer or a professional — with BRAINEE with a view to sitting the IQ Vibe Coding certification. Placing an order entails unreserved acceptance of these CGV, which prevail over any other terms.

The services are sold by BRAINEE, SAS, SIREN 849 355 383, whose registered office is at 7 avenue de Ségur, 75007 Paris. Intra-EU VAT number FR30 849 355 383. Contact: certification@iq-certification.ai.

Description of the offer
BRAINEE sells the sitting of the certification Construire une application grâce au Vibe Coding, registered in the Répertoire Spécifique of France Compétences under number RS7554 (official record: francecompetences.fr/recherche/rs/7554).
The price of the certification includes:
- access to the candidate area and to the application file;
- provision of the exam environment;
- the sitting of one (1) attempt at the exam;
- the assessment and the score feedback on the six skills assessed;
- positioning on the five-level scale (Discovery, Explorer, Operational, Professional, Architect);
- the issuance, where the candidate passes, of a digital certificate and of its public verification page.

Price
Prices are stated in euros, inclusive of all taxes (TTC — toutes taxes comprises), on the website's Pricing page and are restated at the time of payment. The applicable price is the one in force when the order is validated. BRAINEE may change its prices at any time; such changes never apply to orders already validated.

Order & formation of the contract
The order is placed from the candidate area, after creating an account and completing the application file. The contract is formed at the moment payment is confirmed by the banking provider.
The candidate acknowledges having received, prior to the order, clear and comprehensible information on the content of the offer, the price, the conditions for sitting the exam and the rights granted to them in their capacity as a consumer, where applicable.

Payment
Payment is made exclusively online, by bank card, via the provider Stripe Payments Europe Ltd. BRAINEE never has access to the candidate's card data; it is processed by Stripe according to its own security standards (PCI-DSS).
In the event of rejection, chargeback or non-payment, BRAINEE may suspend access to the service until the situation is remedied, or terminate the order automatically (de plein droit).

Invoicing
A personal invoice is issued after payment confirmation and made available in the candidate area. For any amendment request (company name, billing address), the candidate may write to us at certification@iq-certification.ai.

Conditions for sitting the exam
Once payment has been made, the candidate schedules their exam from their candidate area under the conditions specified at the time of the order. The slot may be changed free of charge up to the deadline indicated in the candidate area; beyond that, a new order may be required.
On the day of the exam, the candidate:
- provides proof of identity by the means provided for (identity document, webcam check where applicable);
- has a technical environment that complies with the prerequisites communicated (stable connection, up-to-date browser, authorised equipment);
- complies with the exam instructions and the integrity rules set out in the Terms of Use.

Result & certificate
At the end of the exam, the candidate receives a score out of 100 and a position on the five-level scale. The full scale is public: reading scale.
Where the candidate passes, the certificate is issued in digital format. It is personal, non-transferable and publicly verifiable from the “Verify a certification” page via a unique code.
Published data
The certificate's period of validity is stated on the attestation. Beyond that, the certificate remains verifiable but is flagged as expired.

Failure & new attempt
The exam is paid for irrespective of the result: failure does not give rise to a refund. The candidate may, if they wish, resit the exam by placing a new order. Minimum waiting periods between two attempts, where they exist, are communicated in the candidate area.

Cancellation by BRAINEE
If, for a technical or organisational reason attributable to BRAINEE, the candidate is unable to sit their exam, BRAINEE will offer a new slot. Failing that, or upon request, BRAINEE will refund in full the sums paid within 14 days.

Right of withdrawal (“droit de rétractation”)
In accordance with articles L221-18 et seq. of the French Consumer Code (Code de la consommation), a candidate who is a consumer has a period of fourteen (14) days from the conclusion of the contract to withdraw, without having to give reasons for their decision.
Express waiver
To exercise the right of withdrawal where it applies, the candidate sends an unambiguous request to certification@iq-certification.ai, stating their contact details and the order concerned. The refund is made using the same means of payment as the one used for the order, within 14 days of receipt of the request.

Legal guarantees
A candidate who is a consumer benefits from the legal guarantees provided for by the French Consumer Code (Code de la consommation), in particular the guarantee of conformity (garantie de conformité). As the services are intangible, the notions of return or replacement are replaced, where possible, by the provision of a new exam session or by a refund.

Complaints & consumer mediation
Any complaint may be sent by email to certification@iq-certification.ai. Failing an amicable solution, the consumer may refer the matter free of charge to a consumer mediator (médiateur de la consommation), or to the European online dispute resolution platform: ec.europa.eu/consumers/odr.

Force majeure
Neither party may be held liable for the non-performance of its obligations in the event of force majeure within the meaning of article 1218 of the French Civil Code (Code civil). Obligations will be suspended for the duration of the event; if it continues beyond thirty days, the order may be terminated and refunded.

Governing law
These CGV are governed by French law. Failing an amicable agreement, any dispute will be brought before the competent French courts, subject to the rules applicable to consumers.
